The State Government exempts all registered shops and commercial establishments from Section 11(1) and Section 12(1) of the Act — effectively relaxing the statutory restrictions on fixed daily/weekly working-hour scheduling and the mandatory close/holiday day, allowing greater operational flexibility.

The exemption is conditional on the employer meeting all 7 conditions:

  1. Weekly rest — one paid day off per week to every employee, on a rotational basis.
  2. Working hours cap — max 10 hours/day and 48 hours/week; any extra work must be separately recorded.
  3. Overtime — payable as per law wherever OT is taken.
  4. Appointment letters — mandatory for all employees; a copy to be sent to the area Labour Inspector, with acknowledgement retained on record.
  5. Employee benefits — all other benefits under the Act continue to apply.
  6. Ongoing compliance — exemption is subject to adherence to these conditions and any further government orders.
  7. Auto-revocation — any violation automatically revokes the exemption, exposing the employer to legal action under the Act and other laws.

Bottom line for clients: Establishments in Rajasthan can now operate with flexible hours and without a fixed closed day, but only if they enforce rotational weekly offs, stay within the 10-hour/48-hour limits, maintain OT records, and issue appointment letters (with Inspector intimation). Non-compliance nullifies the relief.
