Gujarat Makes Online Registration Mandatory Under the OSH&WC Code, 2020

The Ahmedabad Division of the Gujarat Labour Department has issued a public notice directing all establishments covered under Section 3 of the Occupational Safety, Health and Working Conditions (OSH&WC) Code, 2020 to complete mandatory online registration.

To enable this, the Gujarat Government has launched the Shram Setu portal on 25 August 2026:

This follows the notification of the Gujarat Occupational Safety, Health and Working Conditions Rules, 2025, which came into force on 21 November 2025.

Who must register

Under Section 2(v) read with Section 3 of the Code, registration is compulsory for every:

  • Factory
  • Building and construction site
  • Industrial establishment
  • Commercial establishment

that employs 10 or more workers.

Timelines

Establishment type Deadline Action required
New establishments Within 60 days of the Code coming into force File Form-1 online and obtain a Registration Certificate
Existing establishments (already registered under earlier labour laws) Within 180 days of the Code coming into force File Form-1 online and get the existing registration certificate updated

Display requirement

Once issued, the Registration Certificate must be prominently displayed at the establishment’s principal place of business – either physically or in digital form.

How to register on Shram Setu

The notification lays out a three-step process (a detailed user manual is available on the portal):

  1. User registration – Fill the user registration form to obtain a User ID and password.
  2. Establishment Master – Complete the establishment’s master details.
  3. Apply – Go to the Application List, select Application for Registration, fill in and submit the application.

Penalty for non-compliance

Owners and responsible persons who fail to register within the prescribed time, or who furnish false information, commit an offence under Section 94 of the OSH&WC Code, 2020, attracting a fine of:

  • Minimum: ₹2,00,000
  • Maximum: ₹3,00,000

  • If you run a factory, construction site, or industrial/commercial establishment in Gujarat with 10+ workers, registration on Shram Setu is no longer optional.
  • Existing establishments must migrate their old registrations via Form-1 – prior registration under the Factories Act, Shops & Establishments Act or other legacy laws does not exempt you.
