Haryana Exempts Dual Registration for Establishments Under OSH Code

The Haryana Government, vide Gazette Notification No. 02/26/2026-2Lab dated May 4, 2026, issued by the Labour Department, has announced a significant relief for businesses operating in the state.

Introduction

Under powers conferred by Section 28 of the Haryana Shop and Commercial Establishments Act, 1958 (Punjab Act 15 of 1958), the Governor of Haryana has exempted establishments from the registration or intimation of business commencement requirements under Section 13 or Section 13A of the said Act.

Who Gets This Benefit?

This exemption applies to any establishment situated in Haryana that gets itself registered under Section 3 of The Occupational Safety, Health and Working Conditions (OSH) Code, 2020 (Act 37 of 2020) — but only after the finalization of the Haryana Rules under the OSH Code.

Why Was This Done?

The key objective is to avoid duplicity of registration and compliance processes. Earlier, establishments had to register separately under both the Shop & Establishment Act and the OSH Code — creating redundancy. This notification streamlines the process.

Important Condition to Note

The exemption is not a blanket relief from the Haryana Shop & Establishments Act, 1958. Establishments must continue to comply with all other provisions of the Act, to the extent they are not inconsistent with the OSH Code, 2020.
