Andhra Pradesh Releases Draft Rules under the Code on Social Security, 2020

The Government of Andhra Pradesh has issued the Draft Code on Social Security (Andhra Pradesh) Rules, 2026, marking an important step toward implementing the Social Security Code at the state level.

These draft rules aim to streamline social security administration and consolidate compliance frameworks previously governed by laws such as the Employees’ Compensation Act, Maternity Benefit Act, and Payment of Gratuity Act.

Key Highlights: 

1. Digital Registration of Establishments
   Employers will be required to register their establishments through an online portal using a common registration form. Registration certificates will be issued electronically, typically within seven days, with a deemed approval mechanism if timelines are not met.
2. Strengthening Social Security for Workers
   The draft rules outline the constitution and functioning of various welfare boards, including the State Unorganised Workers Social Security Board and the Building & Other Construction Workers Welfare Board, which will administer welfare schemes for workers across sectors.
3. Governance Framework for Welfare Boards
   The rules prescribe governance structures, tenure of board members, meeting procedures, and representation requirements to ensure balanced participation from workers, employers, and government representatives.
4. State-Level ESI Society
   The rules also provide for the establishment of an Employees’ State Insurance Society to oversee healthcare services and administrative functions related to ESI within the state.
5. Move Toward Digital Compliance
   A key theme of the draft rules is the shift towards electronic registration, online compliance filings, and digital record maintenance, aimed at simplifying regulatory processes for employers.

What This Means for Employers

Organizations operating in Andhra Pradesh should begin preparing for the transition to the Social Security Code framework by reviewing their current labour law registrations and ensuring readiness for digital compliance systems once the rules are finalized.

Consultation Period

The state government has invited comments and suggestions from stakeholders within 45 days of the notification.
