{"id":3503,"date":"2026-08-31T12:44:44","date_gmt":"2026-08-31T07:14:44","guid":{"rendered":"https:\/\/www.sgcms.com\/regulatory-updates\/?p=3503"},"modified":"2026-08-31T15:16:52","modified_gmt":"2026-08-31T09:46:52","slug":"gujarat-makes-online-registration-mandatory-under-the-oshwc-code-2020","status":"publish","type":"post","link":"https:\/\/www.sgcms.com\/regulatory-updates\/gujarat-makes-online-registration-mandatory-under-the-oshwc-code-2020\/","title":{"rendered":"Gujarat Makes Online Registration Mandatory Under the OSH&#038;WC Code, 2020"},"content":{"rendered":"<p dir=\"ltr\"><strong>Issued by:<\/strong> Office of the Deputy Labour Commissioner, Ahmedabad Division<\/p>\n<p dir=\"ltr\">\u00a0<strong>Date:<\/strong> 27 August 2026<\/p>\n<p dir=\"ltr\">The Ahmedabad Division of the Gujarat Labour Department has issued a public notice directing all establishments covered under <strong>Section 3 of the Occupational Safety, Health and Working Conditions (OSH&amp;WC) Code, 2020<\/strong> to complete mandatory online registration.<\/p>\n<p dir=\"ltr\">To enable this, the Gujarat Government has launched the <strong>Shram Setu portal<\/strong> on <strong>25 August 2026<\/strong>:<\/p>\n<p dir=\"ltr\"><strong>\ud83d\udc49 <a href=\"https:\/\/shramsetu.gujarat.gov.in\">https:\/\/shramsetu.gujarat.gov.in<\/a><\/strong><\/p>\n<p dir=\"ltr\">This follows the notification of the <strong>Gujarat Occupational Safety, Health and Working Conditions Rules, 2025<\/strong>, which came into force on <strong>21 November 2025<\/strong>.<\/p>\n<h3 dir=\"ltr\"><em><strong>Who must register<\/strong><\/em><\/h3>\n<p dir=\"ltr\">Under Section 2(v) read with Section 3 of the Code, registration is compulsory for every:<\/p>\n<ul dir=\"ltr\">\n<li>Factory<\/li>\n<li>Building and construction site<\/li>\n<li>Industrial establishment<\/li>\n<li>Commercial establishment<\/li>\n<\/ul>\n<p dir=\"ltr\"><strong>that employs 10 or more workers.<\/strong><\/p>\n<h3 dir=\"ltr\"><strong><em>Timelines<\/em><\/strong><\/h3>\n<div dir=\"ltr\">\n<table>\n<thead>\n<tr>\n<th scope=\"col\">Establishment type<\/th>\n<th scope=\"col\">Deadline<\/th>\n<th scope=\"col\">Action required<\/th>\n<\/tr>\n<\/thead>\n<tbody>\n<tr>\n<td><strong>New establishments<\/strong><\/td>\n<td>Within <strong>60 days<\/strong> of the Code coming into force<\/td>\n<td>File <strong>Form-1<\/strong> online and obtain a Registration Certificate<\/td>\n<\/tr>\n<tr>\n<td><strong>Existing establishments<\/strong> (already registered under earlier labour laws)<\/td>\n<td>Within <strong>180 days<\/strong> of the Code coming into force<\/td>\n<td>File <strong>Form-1<\/strong> online and get the existing registration certificate <strong>updated<\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n<h3 dir=\"ltr\"><strong><em>Display requirement<\/em><\/strong><\/h3>\n<p dir=\"ltr\">Once issued, the Registration Certificate must be <strong>prominently displayed<\/strong> at the establishment&#8217;s principal place of business \u2013 either physically or in digital form.<\/p>\n<h3 dir=\"ltr\"><strong><em>How to register on Shram Setu<\/em><\/strong><\/h3>\n<p dir=\"ltr\">The notification lays out a three-step process (a detailed user manual is available on the portal):<\/p>\n<ol dir=\"ltr\">\n<li><strong>User registration<\/strong> \u2013 Fill the user registration form to obtain a User ID and password.<\/li>\n<li><strong>Establishment Master<\/strong> \u2013 Complete the establishment&#8217;s master details.<\/li>\n<li><strong>Apply<\/strong> \u2013 Go to the Application List, select <em>Application for Registration<\/em>, fill in and submit the application.<\/li>\n<\/ol>\n<h3 dir=\"ltr\"><strong><em>Penalty for non-compliance<\/em><\/strong><\/h3>\n<p dir=\"ltr\">Owners and responsible persons who fail to register within the prescribed time, or who furnish <strong>false information<\/strong>, commit an offence under <strong>Section 94 of the OSH&amp;WC Code, 2020<\/strong>, attracting a fine of:<\/p>\n<ul dir=\"ltr\">\n<li><strong>Minimum: \u20b92,00,000<\/strong><\/li>\n<li><strong>Maximum: \u20b93,00,000<\/strong><\/li>\n<\/ul>\n<h3 dir=\"ltr\"><em><strong>Key takeaways for employers<\/strong><\/em><\/h3>\n<ul dir=\"ltr\">\n<li>If you run a factory, construction site, or industrial\/commercial establishment in Gujarat with <strong>10+ workers<\/strong>, registration on Shram Setu is no longer optional.<\/li>\n<li>Existing establishments must <strong>migrate<\/strong> their old registrations via Form-1 \u2013 prior registration under the Factories Act, Shops &amp;
