It aims to ease business operations through digital compliance while enhancing worker protections, particularly for establishments in Haryana.\u200b<\/p>\n<p style=\"text-align: justify;\"><strong>Key Features and Applicability<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Applicability Threshold:<\/strong> The Act applies to shops and commercial establishments employing 20 or more workers. Establishments with fewer than 20 workers are required only to comply with a simplified \u201cintimation requirement\u201d (Section 13A), which involves notifying the Labour Department online about business activities.\u200b<\/li>\n<li><strong>Online Registration and Compliance:<\/strong> All covered establishments must <strong>register online<\/strong>. Registration is digital and must be updated promptly for any subsequent changes, including within thirty days from the date of commence of business.\u200b The following details are required for registration:\n<ul>\n<li>the name of the employer and the manager<\/li>\n<li>postal address along with GPS location of the establishment<\/li>\n<li>name of the establishment<\/li>\n<li>number of persons employed in the establishment<\/li>\n<li>nature of the business of an establishment<\/li>\n<\/ul>\n<\/li>\n<li>A registration certificate issued shall be valid until it is amended or cancelled upon closing of the establishment or revoked by the Inspector after verification.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u00a0<strong>Working Hours and Overtime<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Increased Working Hour Limits:<\/strong>\u00a0The daily working hours limit has been increased to <strong>10 hours<\/strong> (earlier 9), with the weekly maximum remaining at<strong> 48 hours<\/strong>. Overtime has been increased from 50 hours to <strong>156 hours per quarter,<\/strong> and must be <strong>voluntary<\/strong>, properly recorded, and compensated at double the normal rate.\u200b<\/li>\n<li><strong>Rest and Breaks:<\/strong>\u00a0The continuous stretch without a break is now up to<strong> 6 hours<\/strong>, an increase from the previous 5 hours.\u200b<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Worker Protection and Employer Obligations<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Appointment Letters and Identity Cards:<\/strong>\u00a0Employers must provide all employees with <strong>appointment letters<\/strong> (with photograph) and identity cards.\u200b<\/li>\n<li><strong>Notification of Closure\/Changes:<\/strong> Any <strong>closure<\/strong> of the establishment must be intimated online within <strong>30 days<\/strong>. Amendments to details (such as name, manager, workforce) require updated registration without any additional fee.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Penalties and Enforcement<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Decriminalization:<\/strong>\u00a0Imprisonment provisions for minor offences have been replaced with monetary penalties, promoting a more business-friendly environment.\u200b<\/li>\n<li><strong>Penalty Structure:<\/strong>\u00a0Fines begin at <strong>\u20b93,000<\/strong> for first offences (failure to register, false records, etc.) and can go up to <strong>\u20b910,000,<\/strong> with daily penalties for continued violations.
